Sentence Reduction (Prop 47)
Under Prop 47, low-level non-violent crimes such as simple drug possession and petty theft can now be reduced to and charged as misdemeanors rather than felonies. The following more common prior convictions may now qualify an individual to be lowered from felonies to misdemeanors amongst others.
- Simple Drug Possession
- Petty Theft under $950
- Shoplifting under $950
- Forging or Writing a Bad Check under $950
- Receipt of Stolen Property under $950
However, Prop 47 does not apply to prior criminal convictions of murder, rape, child molestation or sex offenses.
Additionally, if an individual is currently serving a sentence for one of the above-mentioned offenses, the individual may be eligible for resentencing and release.
